As one of the important tools for maintaining fair competition in domestic markets, anti-dumping measures are frequently adopted by governments worldwide. On April 20, 2024, Chiles Ministry of Finance announced in the Official Gazette an important adjustment to the provisional anti-dumping duties on steel bars originating from China used in manufacturing grinding balls with diameters under 4 inches. According to the latest announcement, the provisional anti-dumping duties have been increased from the original range of 10.3% to 19.8% to a unified rate of 24.9%. This measure took effect from March 27, 2024, and will remain valid for six months until the issuance of final measures. The products involved are primarily classified under Chilean tariff code 7228.3000.

This duty adjustment is based on an anti-dumping investigation self-initiated by Chile on December 9, 2023. The preliminary investigation results were announced on March 27, 2024, when different provisional anti-dumping duties were assigned to various companies: Baowu JFE Special Steel Co., Ltd. was assigned 10.4%, Daye Special Steel Co., Ltd. 10.3%, and Dongbei Special Steel Group Co., Ltd. along with other Chinese companies involved were assigned 19.8%.

Under international trade law, the legality of anti-dumping measures requires strict investigation and evidentiary requirements, including proof of dumping practices and demonstration that such practices have caused or threaten to cause material injury to domestic industries.

Chiles Ministry of Finance will continue to monitor market conditions and complete the final determination before the six-month provisional measure period ends. This will include deciding whether to continue implementing anti-dumping duties and determining the final duty rates. During this period, the involved Chinese companies and other interested parties have the opportunity to submit additional evidence and opinions to Chiles Ministry of Finance to participate in the final determination process.
